Not that it should matter here but my default toolchain is ELDK 5.5.2
I've just (re-)tried building devkit3250 and it builds fine (apart from the warning that the board should be converted to generic).
What commit did you apply the patch series over?
[My toolchain is gcc version 4.7.4 (Ubuntu/Linaro 4.7.4-2ubuntu1) but I agree with you that it most probably does not matter.]
